Rental Agreement


Thank you for choosing Best Price Vacation Homes services. We hope you enjoy your stay at one of our properties!

RENTAL TERMS & CONDITIONS: Our terms and conditions are standard for all property rentals for Guests.
• I must notify Best Price Vacation Homes within four (4) hours of arrival if there is any existing damage to the property or any notable condition.
• I understand that I am responsible for the cost of any damage caused to the property, décor, or its contents during my stay, including the removal of items to another property, breakage, or any excessive cleaning charges incurred during my stay.

PAYMENT TERMS & CONDITIONS: If the booking is made more than 45 days before the scheduled arrival, a deposit of 30% is required.
• The final payment will be charged to your registered credit card unless other payment arrangements have been made and agreed upon.

SECURITY DEPOSIT: A security deposit ranging from $400.00 (four hundred dollars) for (houses up to 5 bedrooms) to $800.00 (eight hundred dollars) for (houses with more than 6 bedrooms) is required and charged for the houses. This is used to cover damages, breakage, or loss of any house contents. The security deposit, minus any charges, will be refunded to the Guest once Best Price Vacation Homes completes its inventory and occupancy report. Refunds will be processed within five (5) business days after the Guest's check-out date.

CREDIT CARD AUTHORIZATION: By clicking the "Accept" button during the booking process, which constitutes acceptance of this Agreement, the Guest agrees and authorizes Best Price Vacation Homes to charge the registered credit card for any additional charges related to damages, inventory replacement, smoking in the unit, pets, extra cleaning, additional or unauthorized guests, events, early check-in, or late check-out.

REQUIRED DOCUMENTS: To validate the booking, the guest must receive the short-time contract, sign it electronically online, and email us at contact@bestpricevacationhomes.com with all the requirements:
(a) A legible copy of the credit card holder's photo ID.
(b) A legible copy of the front and back of the credit card used for the booking.
If a new credit card is provided as a new payment method, the guest must also send all required documents for the new credit card.

PROPERTY OCCUPANCY TERMS: In accordance with Florida State Law, occupancy cannot exceed what is allowed for each house. Maximum occupancy excludes children under three years of age.
• The property is provided for general vacation use only. The vacation rental cannot be used for events or group gatherings that exceed the permitted occupancy. Only guests whose names are on the Rental Agreement are authorized to stay in the house. Any guest hosting events or group gatherings in the house or exceeding the number of authorized guests will be immediately evicted without refund.
• The guest agrees to comply with all HOA association rules, including but not limited to quiet hours from 11:00 PM to 7:00 AM, parking rules, and the no-events policy. Please note that resort HOAs have 24-hour security to monitor resort access.

LAST MINUTE BOOKINGS: For last-minute bookings, to protect against the use of stolen credit cards or fraud, a strict policy will be required for all bookings made within 20 days of arrival or less.
• This strict policy may also be requested for any booking, regardless of the processing date, as a precaution against fraud.
• We may require a new form of payment, such as Venmo, Paypal, Zelle, or a bank deposit.
• A valid copy of the driver's license or passport and credit card must be emailed to our Reservations team.
• The name on the booking must be the same as the name on the credit or debit card used for payment.
• Note that the name on all documents must match: the main guest's name on the booking, the name on the credit/debit card used, and the name on the photo ID.

CANCELLATION POLICY: In case you need to cancel your booking, please note that cancellations must occur at least 30 days before the arrival date. If the cancellation occurs 30 days or more before the arrival date, all money will be refunded, except for a $200.00 administrative fee. GUESTS WHO DO NOT CANCEL WITHIN THE 30-DAY PERIOD WILL BE CHARGED 30% of the reservation amount from 30 days before check-in up to 18 days before. After the 18-day period, the guest will lose the total reservation amount.
• There will be no refund for early departure unless authorities request a mandatory evacuation due to a hurricane. Travel insurance is recommended.

VACATION RENTAL DAMAGE PROTECTION: As part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damage to the rental unit interior that occurs during your stay, provided it is reported to management before check-out. If purchased, the policy will pay a maximum benefit of $3,000. Any damages that exceed $3,000 or are not covered by the plan will be charged to the registered credit card. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property in the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or the actual cash value of such property, up to a maximum benefit of $3,000. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy available at https://www.vacationrentalinsurance.com/g20vrd. The Vacation Rental Damage Protection plan can be purchased up to and including at check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay Best Price Vacation Homes any amount payable under the terms and conditions of the Vacation Rental Damage. If you do not wish to purchase the Vacation Rental Damage Protection, you may add a $3,000 damage deposit.

LIMITED DAMAGE WAIVER
Conditions:
The Limited Damage Waiver Program has certain conditions. The plan will not include liability for damage or theft resulting from:
• Acts of God
• Intentional acts of an enrolled guest
• Gross negligence or willful misconduct
• Any cause, if the enrolled guest does not report the damage to Best Price Vacation Homes staff in writing by the time of check-out
• Normal wear and tear
• Theft without a valid police report
• Damage caused by any pet or other animal brought onto the premises by any guest, regardless of the property being “pet friendly.”
• This plan does not cover loss of use of the covered property
• Coverage does not apply for theft or damage to any property owned by or brought onto the premises by an enrolled guest
• Property damage resulting from any motor vehicle or watercraft operated by an enrolled guest

ADMINISTRATIVE PRODUCE: All waivers of theft or damage will be administered by Best Price Vacation Homes staff at the property. Such staff will have sole authority to determine the nature and extent of damages, necessary repairs, and eligibility for the waiver described herein. The enrolled guest must report any theft or damage to the unit or its contents to Best Price Vacation Homes staff by the time of check-out, or any otherwise applicable damage waiver for such enrolled guest will be void. The Best Price Vacation Homes licensee/owner has ultimate claim administration authority. Arbitration is required before any litigation.
Coverage Terms
• The plan takes effect upon check-in on the booked arrival date to Best Price Vacation Homes unit.
• All coverage will terminate upon normal check-out time of the Best Price Vacation Homes unit or the departure of the enrolled guest, whichever occurs first.
Fee:
• $55.00 for your covered stay.

IMPORTANT NOTE: Violation of any condition of Best Price Vacation Homes terms voids the Limited Damage Waiver Program without refund of any portion of the booking/damage waiver fee. The guest agrees that damages not covered by the Limited Damage Waiver Program or in excess of the Program's limit of $3,000.00 shall be paid immediately. The guest authorizes Best Price Vacation Homes to charge the cost of damages to the guest’s credit card in accordance with this agreement and the terms and conditions of the rental agreement.
By submitting payment for this reservation, you authorize Best Price Vacation Homes to include the costs of this Limited Damage Waiver Program in your reservation. Please contact Best Price Vacation Homes directly if you do not wish to participate in this plan or assignment.

HURRICANE POLICY: Best Price Vacation Homes does not offer refunds or rescheduling of reservations due to hurricane activity. If you are concerned about possible interruptions, cancellations, or delays due to tropical storms, we strongly recommend purchasing travel insurance at the time of booking.

GENERAL BOOKING TERMS AND CONDITIONS:

MINIMUM AGE TO RENT THE HOUSE: The Guest must be at least 21 (twenty-one) years old to rent a vacation home with Best Price Vacation Homes.

SMOKING: Smoking any type of cigarette, vape, or similar inside or in the areas of the house, including the balconies, is not permitted in any property managed by Best Price Vacation Homes at any time. Oil lamps and incense are not allowed due to the long-lasting odor. If a guest is found smoking on the property, they will be contacted and informed about the charges related to cleaning/deodorizing the property and all items (e.g., carpets, furniture, curtains, etc.). These charges will be applied to the credit card registered on the booking. There will be a minimum charge of $350.00.

PARTIES: Parties are strictly prohibited inside the Property without written consent or email from Best Price Vacation Homes, subject to a fine ranging from $600.00 for houses with up to 5 (five) bedrooms, $1,200.00 for 6 (six) bedroom houses, and $2,400.00 for houses with more than 7 (seven) bedrooms, and immediate termination of the contract.

PET POLICY: To ensure the comfort of other guests and help maintain more hygienic accommodations, pets are NOT allowed. If you bring a pet without prior authorization, a non refundable fee of $500.00 per pet will be charged to your credit card, in addition to any damages caused by the pet.

TRASH/REMOVAL: You will be responsible for emptying the full trash bins and disposing of the bags in the appropriate compactor (varies by community). An additional fee of $100.00 (One Hundred Dollars) will be charged to the registered credit card for excessive trash left at the house.

CLEANING SERVICE: There is no daily housekeeping, and cleaning will be performed at check-out. Reservations longer than one month will be charged a cleaning fee after 15 (fifteen) days of occupancy, and a cleaning will be performed every 15 (fifteen) days if the reservation extends beyond 30 (thirty) days. The Guest acknowledges that, on the Arrival Date, the Property is in good condition, except for any defects the Guest may report to the Manager by the end of the first day after the Arrival Date. The Property must be left in the same condition it was found by the Guest on the Arrival Date. The Guest promises to leave the Property in good condition. *Additional cleaning services during the stay may be requested for an additional fee.

JACUZZI: Houses with a Jacuzzi or Pool on the Balcony: There are no additional fees added to the daily rates; this is a courtesy. If a problem occurs during your stay, we do not refund amounts due to the jacuzzi or pool pump not working properly. Do not throw any type of product in the water, subject to a fine of $350.00 or another amount depending on the damage caused to the equipment.

MAXIMUM OCCUPANCY: A fee of $30.00 per person per night will be charged for each person staying at the Property beyond the Rental Party. The guest will be charged without prior notice for additional persons staying at the Property who are not declared to the Manager.

ERRORS OR OMISSIONS: All property descriptions provided on the websites are made in good faith. Best Price Vacation Homes and the property owners accept no responsibility for errors or omissions.

TRAILERS/RVS: The occupation of trailers, enclosed trailers, and/or tents on the premises is strictly prohibited.

PARKING: Parking is limited by the type of house and the rules of each condominium or resort. The Guest may only park in the designated area and must not exceed the number of spaces assigned to the house. Any illegally parked cars may be subject to towing and/or fines.

SUBLEASING: The Rental Agreement cannot be transferred to third parties, nor can the property be sublet. No locks may be broken, altered, or added.
• The guest is granted a license to use the premises. The guest acknowledges and agrees that no form of tenancy has been created under Chapter 83 of the Florida Statutes by the guest's use of the property.
• Any dispute under this Agreement will be resolved exclusively through binding arbitration, in accordance with the rules of the American Arbitration Association for commercial disputes in Orange County, Florida, applying Florida law. Each party will pay its own costs and attorneys' fees, and the State of Florida will have exclusive personal and in rem jurisdiction over any dispute.

ITEMS LEFT IN THE HOUSE: In the event a guest leaves any personal items at the rental property, we will make every effort to locate the item. Best Price Vacation Homes is not responsible for any loss under any circumstances. If the item is found, the guest will be notified and given the contact details of a local company specializing in collecting and shipping packages. The guest will be responsible for arranging the collection and any costs incurred.
Bedding such as sheets, duvets, bath towels, hand towels, and pool towels are included and must not be removed from the unit. An initial kit of 2 trash bags, 1 paper towel, 1 dish detergent, 2 dishwasher sachets, 2 laundry detergent sachets, 2 rolls of toilet paper, soap, shampoo, and conditioner in each bathroom is provided. Once this initial kit is used up, the guest will be responsible for any additional items needed during the stay. Guests will need to supply their own paper products and cleaning supplies. Any additional items required are the guest's responsibility.
A one-time cleaning fee, which is already included in the total rental price as stated in your contract, will be performed at the end of the rental period (unless the reservation exceeds one month, in which case additional cleaning fees will be charged).
Additional cleaning fees will apply if abnormal use of the property results in the need for more extensive cleaning to return the unit to the condition it was in before your rental, or if cleaning involves the removal of excessive debris.

UTILITIES, INTERNET: No compensation will be offered for temporary interruptions of electricity, gas, water, cable, internet, or telephone service (some units may not have telephone service). Interruptions will be reported immediately, and every effort will be made to restore them as quickly as possible. Please note that you may want to bring a cell phone or calling card to make long distance calls, as these are restricted. If utility costs exceed the average of the last 3 months before your check-in and are considered excessive, you will be responsible for paying the difference.

KEYS/PROPERTY ACCESS: You will receive a code for the electronic door lock, which will be sent to you along with the check-in/check-out procedures email prior to your arrival. DO NOT GO TO THE RESORT RECEPTION.
All our homes have electronic locks with a password. If keys are issued for resort access outside of business hours, they must be left in the unit at check-out inside the lockbox next to the front door. Lost keys will be charged $80.00 per key.

LINENS/TOWELS/SUPPLIES: The owner provides bed linens and towels. Any missing, damaged, or stained bedding or towels will be deducted from your security deposit, or you will be charged for these items.
Additional items are the responsibility of the guest. We recommend that you bring any special items you may need or purchase them during your stay, such as cleaning products and cooking condiments.
Missing, damaged, or stained bedding or towels will be charged as follows:
$20.00 for each bath towel and hand towel
$3.00 for each face towel (if available in the house)
$28.00 for each bed linen and pillow
$30.00 for each remote control
$40.00 for each pot, pan, or dish.

AIR CONDITIONING: The guest agrees not to adjust the temperature below 70°F or above 76°F. When the air conditioner is in use, we ask that all windows and doors be closed to reduce humidity and save energy.

CHECK-IN: Check-in time is from 4.00 PM. The property will have an electronic lock for your convenience. This code will be sent 48 hours before your check-in via email with check-in instructions. This code will be activated at 4:00 PM, the check-in time.
• Early arrival can be arranged for an additional fee if the house does not have a scheduled departure of another guest. This option is available only 2 (two) days before your arrival.

CHECK-OUT: Check-out time is by 10:00 AM. It is not necessary to clean the house or wash the linens or dishes. However, there will be an additional cleaning fee if the house is left in a condition that requires excessive or additional cleaning.
• You must take out the trash on the designated days, as indicated in the property.
• If the guest does not leave the house by 10:00 AM without a previously arranged late check-out, preventing Best Price Vacation Homes from cleaning and preparing the house for the next guest arriving on the same day after 4:00 PM, the departing guest agrees to pay the damages and costs incurred by Best Price Vacation Homes, including but not limited to moving the next guest to another house. A late check-out can be arranged for an additional fee if the house does not have another guest scheduled to arrive. This option must be arranged in advance and cannot be added on the day of departure.

POOL AREA/SPA/POOL HEATING: The guest understands that no lifeguard is on duty, and it is a condition of using the property that the use of the pool is entirely at the guest's own risk. Diving, playing, or running around the pool area is prohibited. No child or non-swimmer in the group will use the pool without proper supervision from an adult or an experienced swimmer. The guest must immediately report any problem with the pool alarms or safety fences. All guests understand and agree that neither the property owner nor Best Price Vacation Homes can accept responsibility in case of an accident or illness while staying at the property.
• According to Chapter 515.33 of the Florida Residential Pool Safety Act: Any person who tampers with or disconnects pool alarms commits a second-degree misdemeanor, punishable by a fine of $5,000 or 1 (one) year in prison. Please do not tamper with the pool alarms.
• If there is a pool on the unit, and you request pool heating, an additional energy fee will be applied per night. This fee can vary from $35.00 to $50.00 depending on the size of the pool. The guest must contact us for further information. Pool heating must be for a minimum of 3 (three) days. Pool heaters are heat pumps that vary with ambient temperatures and will heat, on average, 10 to 15 degrees Fahrenheit above the ambient temperature (rain and wind also affect pool temperature). In cold temperatures, pool heat pumps may not function when temperatures drop below 60 degrees Fahrenheit. The maximum water temperature that can be reached is between 83°F and 90°F. All heaters are set with timers and do not heat during the night, so temperature loss may occur during the night but will be recovered during the day.
It is not allowed to throw products, detergents, foams, or any type of items that may damage the pool or water treatment, causing damage to the house, subject to a fine that may range from $500.00 up to the amount needed for proper repair.

RENTAL TERMS: The guest agrees, and Best Price Vacation Homes allows the rental period to begin and end on the dates and times shown as the rental period as stated in the Rental Agreement.
Best Price Vacation Homes is an independent management company that manages individual and private rental properties. The guest acknowledges that Best Price Vacation Homes is not responsible if access to any resort amenities is restricted due to maintenance, resort policies, or any other reason.
• No refunds will be granted for late arrivals, early departures, or unused days of your rental property reservation.

FORGOTTEN ITEMS: Carefully check your belongings before leaving. Forgotten items may be sent to you upon request, and you will be charged for shipping costs, along with a service fee of $20. Best Price Vacation Homes is not responsible for lost or stolen items.

RIGHT OF ENTRY: Guests agree that Best Price Vacation Homes reserves the right to enter the rental property at any time to investigate disturbances, verify occupancy, check for damage, perform repairs, modifications, or improvements as deemed necessary, or show the property to potential buyers or guests (in this case, prior notice will be provided).

SECURITY AND SAFETY RISKS: ALWAYS LOCK DOORS AND WINDOWS WHEN YOU LEAVE THE RENTAL! When you rent the unit, you assume responsibility for it and its contents, as well as your personal belongings. Always lock the doors and windows when you leave the rental property. Children are welcome, but there are conditions in and around the house that may be dangerous for them as well as for adults, such as the river, steep hills, open staircases, wildlife, icy surfaces, and fireplaces. Best Price Vacation Homes does not assume any responsibility for injuries resulting from your failure to take due care. Children must be supervised at all times. Candles are not allowed due to fire risk. The discharge of firearms is prohibited within or near the property. Failure to comply will result in a $500 charge to the registered credit card and immediate removal from the property.

LIMITATION OF LIABILITY: Community and home amenities are used at the guest's own risk. Guests should exercise caution when using stairs, elevators, showers, bathrooms, and walkways. Best Price Vacation Homes and the property owner(s) accept no responsibility for any personal loss, injury, or illness, and will not be held liable for the personal safety of the guest or their travel party.
Best Price Vacation Homes and/or the property owner will not release the physical address of the property to the guest before receiving a signed and valid Rental Agreement as well as the full rental payment. At that time, the guest will receive a rental voucher via email, which will include the property address and all other necessary arrival information.
Best Price Vacation Homes and/or the owner are not responsible for equipment and/or service failures at the property. In case of equipment failure, the guest must notify Best Price Vacation Homes within one (1) business day for Best Price Vacation Homes to decide whether to correct the failure.
Best Price Vacation Homes and/or the property owner accept no responsibility for losses or thefts of the guest's personal belongings inside the property during the rental period. If the guest's belongings are lost or stolen, the guest must first notify the proper authorities and then contact Best Price Vacation Homes to report the lost or stolen items.
• The guest must ensure that children are supervised at all times. It is the policy of Best Price Vacation Homes that all children under the age of 18 must not be left alone in the rental home at any time during the rental period.
• Toys, furniture/baby equipment, strollers, rental cribs are used at the guests' own risk.
Best Price Vacation Homes accepts no responsibility for viral pandemics, acts of violence, natural disasters, fires, floods, wars, civil unrest, riots, or other force majeure events that may have an adverse effect on the guest. There will be no relocation, rent sharing, or refunds in such circumstances.
• We cannot accept responsibility for utility failures such as water, electricity, gas, or phone/internet services. Nor for the consequences of the actions or omissions of persons who may provide or control the main services or for any action taken in the vicinity of the reserved property by any authority or person over whom we have no control. We cannot accept responsibility for air conditioning system failure, pool heater failure, or any household appliance failure. Urgent measures will be taken to have a local engineer resolve any issue.
• We assume no responsibility for loss, damage, or changes to your reservation caused by events outside of our control, including but not limited to wars, terrorist activities, civil unrest, flight delays or cancellations, airport closures, adverse weather conditions, fires, floods, or industrial disputes. No credit will be given for shortened stays due to late arrivals or early departures for any reason, and no credit will be given for cancellations due to weather conditions.
• The use of barbeque grills (BBQs) is at the guests' own risk, and Best Price Vacation Homes cannot accept any responsibility for injuries of any kind that may arise from using the grills. The guest assumes full responsibility for connecting gas cylinders. Guests should also remember to keep children away from the grills, whether in use or not.
Best Price Vacation Homes does not accept responsibility for pool heating failures to provide adequate heat when pool heating is done via an electric heat pump and when the outside temperature falls below 60 degrees Fahrenheit. Electric heat pumps do not operate efficiently below this temperature, and the failure of such devices to heat the pool is outside of Best Price Vacation Homes' control and is considered an act of nature.
• Failure to comply with any of the terms described here will result, at the sole discretion of Best Price Vacation Homes, in the eviction of the guest from the property without refund.

FORCE MAJEURE: Circumstances beyond our control may arise where the property may not be available for your reservation. Examples of such circumstances include but are not limited to property destruction, property sale, nearby construction, water, gas, or sewage leaks, fire, or any other damage that renders the property uninhabitable or potentially uninhabitable.
• In the event of force majeure, Best Price Vacation Homes will make every effort to provide alternatives. If these alternatives are not acceptable to the guest, Best Price Vacation Homes will refund all money paid. If the guest accepts alternative accommodation, they also agree to relocate back to the original property when deemed available by Best Price Vacation Homes. This will be the full extent of our liability to the guest, and we will not be liable for any other costs related to such cancellation, whatever the reason.

MECHANICAL FAILURES: Best Price Vacation Homes strives to maintain the property adequately. Although all electrical and mechanical equipment within the property is in good working condition, the manager cannot guarantee against mechanical failures of the electrical service, plumbing, water supply, heating, air conditioning, audiovisual equipment, internet access, cable service, or appliances. The guest agrees to report any inoperative equipment or other maintenance problems to Best Price Vacation Homes immediately. Best Price Vacation Homes will make every reasonable effort to make repairs quickly and efficiently. The guest will allow Best Price Vacation Homes or a person authorized by Best Price Vacation Homes access to the property for repair and inspection purposes. Best Price Vacation Homes is not responsible for any inconvenience that may occur, and no refunds or rental reductions will be made due to the failure of these items.

ACTS OF GOD: No refunds will be given if there is a storm or severe weather conditions (e.g., hurricane, earthquake, wildfire), even if a mandatory evacuation order has been given. Best Price Vacation Homes will not be responsible or deemed in default under this agreement for any failure to perform or delay in performance of any of its obligations due to or resulting from any cause beyond its control, including, without limitation, acts of God.

LIMITATIONS AND LIABILITIES: Best Price Vacation Homes is not responsible for accidents, injuries, or illnesses that occur to any member of the Rental Party or guest's visitors while on the property or in common areas at the property. Best Price Vacation Homes is not responsible for the loss of personal belongings or valuables belonging to any member of the Rental Party or guest's visitors left behind or forgotten at the property. The guest agrees to assume the risk of any damage arising from the use of the property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, WILL THE OWNER BE LIABLE TO THE GUEST OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE ARISING OR RELATED TO THIS AGREEMENT OR THE GUEST'S RENTAL OR USE OF THE PROPERTY. IN NO EVENT WILL BEST PRICE VACATION HOMES BE LIABLE FOR ANY DAMAGES IN CONNECTION WITH THIS AGREEMENT, EVEN IF THE MANAGER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

INDEMNIFICATION: The guest acknowledges that the use of the property and common areas by the Rental Party and its visitors is entirely at their own responsibility and risk. The guest will indemnify and hold harmless Best Price Vacation Homes from any and all expenses, costs, damages, lawsuits, actions, or liabilities of any kind arising from or related to any loss or damage to personal property, injury, or death resulting from the use or occupancy of the property or the failure of any member of the Rental Party or guest's visitors to observe the Rules and restrictions set forth in Paragraph 7.

BREACH OF CONTRACT: If the guest, visitors, or any member of the Rental Party violates any of the terms of this Agreement, including but not limited to maximum occupancy, rental rules, and restrictions, Best Price Vacation Homes may evict the guest and the Rental Party from the property, and the guest will forfeit all rent and security deposits paid.

GOVERNING LAW: This Agreement and all transactions contemplated by this Agreement will be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising from this Agreement will be resolved by mediation. If the dispute cannot be resolved by mediation, it will be resolved by binding arbitration conducted in accordance with the rules of the American Arbitration Association.

AMENDMENTS: These Terms and Conditions may only be amended or modified by a written agreement signed by both Best Price Vacation Homes and the guest.

NO WAIVER: Neither Best Price Vacation Homes nor the guest will be considered to have waived any provision of this Agreement or the exercise of any rights held under this Agreement unless such waiver is expressly made in writing.

SEVERABILITY: If any provision of this Agreement is found to be invalid or unenforceable, in whole or in part, the remaining provisions will not be affected and will continue to be valid and enforceable as if the invalid or unenforceable parts were not included in this Agreement.

NOTIFICATIONS: Any notification or communication under this Agreement must be made in writing and sent to the following email contact@bestpricevacationhomes.com

SUCCESSORS AND ASSIGNS: This Agreement will benefit and be binding upon the Owner, its successors, and assigns, and upon the guest and their permitted successors and assigns.

ENTIRE AGREEMENT: This Agreement represents the complete understanding and agreement between the parties with respect to the subject matter of this Agreement and supersedes all other negotiations, understandings, and representations.
